Terms of service

Welcome to Tomosino. These Terms of Service form a legally binding agreement between you and Tomosino, a brand operated by Gardashov LLC, governing your access to and use of tomosino.com and all related products and services. By using the Site or placing an order, you agree to these Terms.

1. Who we are

2. Eligibility

To place an order you must be at least 18 years old.

3. Pre-contract information

The information we are required to give you before you order under Schedule 2 to the Consumer Contracts Regulations 2013 — including the main characteristics of the goods, our identity and address, the total price, delivery arrangements, the right to cancel and the obligation to bear return costs — is set out in these Terms, on our product pages, and in our returns policy and delivery policy.

4. How the contract is formed

Products shown on the Site are an invitation to treat, not an offer. Your order is an offer to buy. A contract is formed only when we send you an email confirming that your order has been dispatched. We will send confirmation on a durable medium as required by regulation 16.

We may decline an order where goods are unavailable, where there is an obvious pricing error, or where we suspect fraud. In that case we refund you in full.

5. Prices, VAT and import charges

Prices are shown in pounds sterling (GBP).

Prices do not include UK VAT or customs duty. Gardashov LLC is a US company and is not registered for VAT in the United Kingdom, so no UK VAT is charged at checkout. Because your order is imported, import VAT (standard rate 20%) may be charged on arrival, customs duty may apply where the goods exceed £135, and the carrier may add a clearance fee. These are payable by the recipient. Full details are in our delivery policy.

Prices may change, but the price that applies to your order is the one displayed when you placed it.

6. Payment

Payment is taken through the providers shown at checkout. We do not store full card details.

7. Delivery

Processing and delivery estimates are in our delivery policy. We will deliver within 30 days of the contract being formed unless we agree otherwise with you; if we do not, you may treat the contract as at an end and receive a full refund. Risk passes to you when you take physical possession of the goods (section 29, Consumer Rights Act 2015).

8. Cancellation, returns and refunds

Your statutory 14-day right to cancel, and our additional 30-day returns policy, are set out in our returns policy, which forms part of these Terms.

9. Quality of goods

Under the Consumer Rights Act 2015 goods we supply must be of satisfactory quality, fit for purpose and as described. Your remedies, including the 30-day short-term right to reject, are explained in our returns policy. We do not exclude or restrict these rights in any way.

10. Intellectual property

All content on the Site — text, photography, graphics, logos and the Tomosino name — belongs to Gardashov LLC or its licensors. You may not reproduce or use it commercially without our written permission.

11. Content you submit

If you submit reviews or photographs you grant us a non-exclusive, worldwide, royalty-free licence to use them to promote the brand. You are responsible for what you post and confirm you have the right to post it. We publish reviews honestly and do not remove genuine negative reviews.

12. Acceptable use

You must not use the Site unlawfully, attempt to compromise its security, scrape it by automated means, impersonate others or interfere with its operation.

13. Third-party links

The Site may link to third-party websites. We do not control their content or privacy practices and are not responsible for them.

14. Our liability

We are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or failing to use reasonable care and skill.

We do not exclude or limit our liability in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for any breach of your statutory rights in relation to the goods.

We are not liable for business losses. If you use the goods for any commercial purpose we will have no liability for loss of profit, loss of business, business interruption or loss of business opportunity.

15. Events outside our control

We are not liable for delay or failure caused by events outside our reasonable control, including extreme weather, industrial action, carrier failure or acts of government. Where such an event occurs we will contact you and you may cancel and receive a refund for goods not delivered.

16. Privacy

We handle your personal data in accordance with our privacy policy, prepared under UK GDPR and the Data Protection Act 2018.

17. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales.

You may bring proceedings in the courts of England and Wales. If you live in Scotland you may bring proceedings in either Scotland or England and Wales; if you live in Northern Ireland, in either Northern Ireland or England and Wales. We will only bring proceedings against you in the courts of the country in which you live.

We do not require you to submit to arbitration and we do not restrict your right to bring or take part in group claims.

18. Complaints

Please contact us first at support@tomosino.com — most issues are resolved quickly. You can also obtain free, impartial advice from Citizens Advice (citizensadvice.org.uk, consumer helpline 0808 223 1133). Nothing here affects your right to go to court.

19. Changes to these Terms

We may change these Terms. Changes take effect when published and do not apply to orders already placed, which remain governed by the Terms in force when you ordered.

20. General

If any provision is found to be unlawful or unenforceable, the remaining provisions continue in force. Our failure to enforce a right is not a waiver of it. These Terms, together with our privacy, delivery and returns policies, form the entire agreement between us.
