This Privacy Policy explains how Tomosino ("Tomosino", "we", "us" or "our"), a brand operated by Gardashov LLC, collects, uses, shares and protects your personal data when you visit tomosino.com (the "Site") or buy from us. It is provided in accordance with the UK General Data Protection Regulation and the Data Protection Act 2018.

We are the controller of the personal data described in this policy. For any privacy question or request, please contact us at support@tomosino.com.

2. Personal data we collect

  • Identity and contact data: name, email address, telephone number, delivery and billing address.
  • Order data: items purchased, sizes, order history and correspondence with customer support.
  • Payment data: handled directly by our payment provider. We do not store or have access to your full card number.
  • Technical and usage data: IP address, device and browser type, pages viewed, and data collected through cookies.
  • Customs data: information required for the customs declaration accompanying your parcel.

We do not collect special category data. Our Site is not directed at children under 13 and we do not knowingly collect their data.

3. Purposes and lawful bases

  • Processing and delivering your order, handling returns and support — performance of a contract, Article 6(1)(b).
  • Tax, accounting and customs obligations — legal obligation, Article 6(1)(c).
  • Fraud prevention and site security — legitimate interests, Article 6(1)(f).
  • Marketing emails — your consent, Article 6(1)(a), in line with the Privacy and Electronic Communications Regulations 2003. You can withdraw consent at any time using the unsubscribe link in any message.
  • Analytics and advertising cookies — your consent, Article 6(1)(a), given through our cookie banner.
  • Establishing or defending legal claims — legitimate interests, Article 6(1)(f).

4. Who we share your data with

  • Our ecommerce platform and payment providers
  • Carriers and fulfilment partners delivering your order
  • Customs agents and HM Revenue & Customs, where an import declaration requires it
  • Email, analytics and advertising providers
  • Professional advisers and public authorities where the law requires

We do not sell your personal data.

5. International transfers

This matters, so we state it plainly. Gardashov LLC is established in the United States, and several of our processors are also outside the UK. Your personal data is therefore transferred outside the United Kingdom.

Where we make such a transfer we rely on:

  • the International Data Transfer Agreement, or the UK Addendum to the EU Standard Contractual Clauses, issued under Article 46 UK GDPR; or
  • where relevant, the UK Extension to the EU–US Data Privacy Framework for certified recipients; or
  • for transfers strictly necessary to perform our contract with you, Article 49(1)(b).

6. How long we keep your data

  • Order and transaction records — six years, to meet UK tax and accounting requirements.
  • Data processed with your consent — until you withdraw it.
  • Data needed for legal claims — until the relevant limitation period expires.

7. Your rights

Under UK GDPR you have the right to:

  • access your personal data and receive a copy — Article 15;
  • rectification of inaccurate data — Article 16;
  • erasure — Article 17;
  • restriction of processing — Article 18;
  • data portability — Article 20;
  • object to processing based on legitimate interests, including direct marketing — Article 21;
  • withdraw consent at any time, without affecting processing carried out before withdrawal — Article 7(3).

Email support@tomosino.com to exercise any of these. We respond without undue delay and within one month; where a request is complex we may extend by up to two further months and will tell you why (Article 12(3)). Exercising your rights is free of charge.

Some records must be retained despite an erasure request, where tax, accounting or customs law requires it.

9. Cookies

We use cookies to make the Site work, remember your basket, measure performance and show relevant advertising. Analytics and advertising cookies are set only with your consent, which you can change or withdraw at any time. We use appropriate technical and organisational measures, including SSL/TLS encryption, to protect your data against loss, misuse and unauthorised access. No system is completely secure, but we work continuously to keep your data safe.

We may update this policy. The current version is published at tomosino.com with the date of last update. If a change is significant we will tell you by email.
